American companies file lawsuits to prevent Trump tariffs, argue that trade imbalances do not pose a crisis

A group of five small businesses has filed a lawsuit against President Donald Trump, challenging the tariffs he has imposed on foreign imports. The lawsuit, filed in the U.S. Court of International Trade, argues that Trump has overstepped his authority by claiming trade deficits with other countries constitute an emergency, allowing him to levy tariffs under the International Emergency Economic Powers Act. The businesses, represented by the Liberty Justice Center, argue that trade deficits do not constitute an emergency and that the tariffs are harming small businesses across the country. The plaintiffs include companies such as VOS Selections, FishUSA, Genova Pipe, MicroKits LLC, and Terry Precision Cycling, all of which have been impacted by the tariffs. The lawsuit seeks to declare Trump’s actions illegal and prevent the implementation of further tariffs under the IEEPA. Terry Cycling, for example, has already paid $25,000 in unplanned tariffs this year and expects to face significant costs in the coming years. The businesses argue that the tariffs are unsustainable and threaten their survival. CNBC has reached out to the White House for comment on the lawsuit.
