Utah Supreme Court issues decision on teenager’s case challenging climate change policies

The Utah Supreme Court recently made a decision regarding a lawsuit filed by a group of teenagers against the state, claiming that its fossil fuel policies contribute to climate change and harm their lives. The Court upheld a lower court’s decision to dismiss the lawsuit but allowed the teens to bring a new legal challenge in the future. The teens, represented by Our Children’s Trust, argued that Utah’s heavy reliance on fossil fuels violates the state constitution’s “right to life” provision. The Court’s ruling focused on technical matters and noted a change in the law by the state legislature regarding energy policy.

Justice Diana Hagen wrote in the opinion that the challenged provisions in the lawsuit did not limit the government’s discretion in making decisions about fossil fuel development. However, she left the door open for the teens to bring a new legal claim, ordering the lawsuit to be dismissed “without prejudice.” The teens and their lawyer expressed optimism about the ruling, stating that it provides a clear path forward for their challenge to the state’s promotion of fossil fuel development. They emphasized the importance of safeguarding the future by rejecting fossil fuel activities in favor of renewable energy.

One of the plaintiffs, Natalie R., signaled her commitment to continuing the fight against fossil fuel development, stating that their demand for the state to use its authority to protect the future remains strong. Overall, the ruling by the Utah Supreme Court has allowed the teens to pursue their challenge to the state’s energy policies in the future.
