Utah’s public records law benefits all citizens, not just journalists, by promoting transparency in government

Dan Schroeder, an Ogden resident and physics professor at Weber State University, initially dismissed rumors of corruption at Ogden City Hall in 2008. However, after persistent rumors regarding donations to a nonprofit benefiting political campaigns, Schroeder took action. He filed a public record request, leading to a yearslong legal battle that eventually reached the Utah Supreme Court. The court ruled in Schroeder’s favor, granting him access to bank records that confirmed the misuse of funds by local politicians.

Schroeder’s success highlights the importance of citizen involvement in holding government accountable, particularly through Utah’s Government Records Access and Management Act (GRAMA). However, a recent bill, HB69, threatens to make it difficult for Utahns to recover attorney fees when fighting for transparency. First Amendment attorney Jeff Hunt warns that this could discourage individuals from challenging the government’s withholding of public records.

Despite the challenges he faced, Schroeder’s efforts led to a significant impact in curbing unethical practices in local politics. He believes that the transparency brought about by his case and similar citizen-driven efforts has contributed to reducing such “shenanigans” in government. Schroeder emphasized the importance of tools like GRAMA in empowering citizens to demand accountability from their elected officials.

While Schroeder’s case had a lasting effect on local politics in Ogden, the potential implications of HB69 have raised concerns about the ability of ordinary Utahns to challenge government secrecy. With the bill now awaiting the governor’s decision, advocates like Hunt and the Utah Media Coalition are urging for a veto to protect citizens’ access to public records and ensure accountability in government.
