Idaho House Urges U.S. Supreme Court to Overturn Same-Sex Marriage Ruling, Reports Utah News Dispatch


The Idaho House of Representatives has passed a memorial calling for the U.S. Supreme Court to reverse the 2015 ruling that granted same-sex couples the right to marry. The memorial, known as House Joint Memorial 1, does not have the force of law but expresses the Idaho Legislature’s rejection of the Obergefell v. Hodges decision and calls for marriage to be defined as a union between one man and one woman.

Sponsored by Rep. Heather Scott, the memorial sparked a heated debate on the House floor, with Scott arguing that marriage is a decision that should be left to the states. However, the memorial itself calls on the U.S. Supreme Court to define marriage, not the states.

While 15 Republicans joined House Democrats in opposing the memorial, it still passed comfortably with a 46-24 vote. Opposition to the memorial came from concerns about LGBTQ+ rights and the impact on individuals in same-sex relationships. Despite the resistance, the House Republicans were able to push it through.

The memorial now moves to the Idaho Senate for consideration. If approved, it does not require the governor’s signature to take effect. The debate over same-sex marriage continues in Idaho, where a 2006 constitutional amendment defining marriage as between a man and a woman was overturned by a federal judge in 2014 and subsequently legalized by the U.S. Supreme Court in 2015.
