Vanuatu Urges World Court to Acknowledge the Devastating Impacts of Climate Change


Vanuatu urged the United Nations court to recognize the harm caused by climate change and the legal obligation of countries to fight it. Vanuatu, a small island state, emphasized the urgent need for a response to climate change rooted in international law. The country called for recognition that current conduct causing harm must cease and be repaired. The hearings at the International Court of Justice come after the COP29 summit, where richer countries agreed to provide $300 billion in annual climate finance by 2035, but developing nations found this inadequate.

While the court’s advisory opinion on climate change is not legally binding, it is significant and could impact future climate change-driven lawsuits globally. Youth climate activists from Solomon Islands stressed the uncertainty of the future for young people in small island states due to the actions of a few greenhouse gas-emitting countries. Saudi Arabia and Germany argued that the obligations of states regarding climate change are already established in existing agreements like the Paris climate accord.

China and the United States, the top two greenhouse gas emitters, are also scheduled to provide their views to the court. OPEC, however, will not be addressing the court. The hearings will continue until December 13, with the court’s opinion expected to be delivered in 2025. The outcome of these proceedings could have significant implications for climate change-related legal and political actions in the future.
