Georgia judge stops regulation mandating counties to manually count Election Day ballots


A Georgia judge issued a temporary injunction blocking a new rule from the state’s election board that would have required ballots cast on Election Day to be counted by hand. The judge found that implementing the rule so close to the election would cause administrative chaos and uncertainty. The rule was set to take effect two weeks before Election Day and sparked concerns about delays in reporting results and potential disruptions in a key state in the presidential election.

The rule was approved by three board members who have been praised by former President Donald Trump, and was opposed by Democrats in the state, as well as by the Republican secretary of state and attorney general. The Democratic National Committee, the Democratic Party of Georgia, and Vice President Kamala Harris’ campaign filed a lawsuit to halt the rule from going into effect.

Hand-counting of ballots has become a focus for some on the right in response to unfounded claims of election fraud, despite evidence that using ballot tabulators is more efficient and accurate. Georgia has been a primary target for Trump’s baseless claims of election theft, with him praising the board members who passed the hand-counting rule.

In addition to the hand-counting rule, the same board members passed other rules in August allowing county election board members to conduct inquiries before certifying results, potentially causing further chaos and delays. Critics say that the lack of a defined standard for “reasonable inquiry” could allow individual board members to block certification for any reason.
